Introduction

These Terms of Service ("Terms") apply to and govern your access to and use of any website, mobile site or app, and any other digital platform, including any services, features, pages, and functions contained or offered therein, including any transactions, orders, sales, purchases, or the acquisition of goods or services (collectively the, or our, "Services"), that are owned, operated, or provided by ItsWorthMore Limited or its subsidiaries, divisions, and affiliates ("ItsWorthMore" or "we" or "us").

ItsWorthMore offers Services through which you can sell certain consumer electronic products ("Product" or "Products") after receiving an offer to purchase from ItsWorthMore ("Offer"). Completing a Trade-In ("Trade-In") requires you to identify your Product, describe its condition, and complete check-out on the ItsWorthMore Website. By using the Trade-In Services, you agree to abide by these Terms.

All Services, including the information, tools, goods, and products available through them, are offered to you conditioned upon your acceptance of these Terms and all other terms, conditions, policies, and notices stated herein or incorporated by reference. Please read these Terms carefully before making any transaction with us or otherwise using the Services.

By making any transaction or by visiting or otherwise using the Services, you acknowledge, accept, and agree to be bound and abide by these Terms and our Privacy Policy (which is incorporated herein by reference), both on your behalf, and, as applicable, on behalf of the company or juridical entity that you are affiliated or associated with, and you represent and warrant that you have the authority to bind such entity to our Terms and Privacy Policy. If you do not have such authority, or if you do not agree to these Terms or our Privacy Policy, then accessing the Services is strictly prohibited, and you must immediately exit and cease using the Services.

By using the Services, you further agree that you are at least eighteen years of age and are the legal age of majority in the jurisdiction in which you reside. No person under the age of eighteen is permitted to provide their personal information in any capacity through the Services, even if they have obtained parental consent to do so. The Services are only offered and available to users who are at least eighteen years of age or older. IF YOU ARE UNDER THE AGE OF EIGHTEEN YOU ARE NOT AUTHORISED TO USE THE SERVICES.

These Terms apply only to customers and businesses located in the United Kingdom (including England, Wales, Scotland, and Northern Ireland).

Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.

We reserve the right to change these Terms at any time and at our sole discretion. Any changes to the Terms will be effective immediately upon posting and you agree to the new posted Terms by continuing your use of the Services. It is your responsibility to check periodically for any changes we may make to these Terms.

THESE TERMS AFFECT YOUR LEGAL RIGHTS, RESPONSIBILITIES, AND OBLIGATIONS, GOVERN YOUR USE OF THE SERVICES, ARE LEGALLY BINDING, AND LIMIT ITSWORTHMORE'S LIABILITY TO YOU. YOUR CONTINUED USE OF THE SERVICES AFFIRMS YOUR AGREEMENT TO THESE TERMS. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS OR ANY FUTURE MODIFICATIONS OR AMENDMENTS TO THESE TERMS, DO NOT USE OUR SERVICES.

Definitions

"Device" means any phone, tablet, laptop, wearable, gaming console, or electronic item submitted.

"Original Quote" or "Valuation" means the price you receive when describing your Device online.

"Revised Offer" means the updated price after inspection if the Device's condition differs from your description.

"Consumer" means an individual acting wholly outside business purposes.

"Business Seller" means a business or sole trader selling Devices commercially.

"Business Buyer / Reseller" means a business purchasing Devices from ItsWorthMore.

"Shipping Protection" means the optional shipping upgrade that enhances courier compensation limits; it is not insurance. Shipping Protection is a contractual service arrangement and does not constitute insurance or a regulated insurance product.

"Margin Scheme" means the VAT second-hand goods scheme under which we operate.

"Quality Assessment" means the inspection of incoming Devices performed by our team of technical specialists.

"Grace Period" means the fourteen (14) day period during which you may accept or decline a Revised Offer. If you do not respond within the Grace Period, you expressly authorise us to treat your non-response as acceptance of the Revised Offer and to proceed with payment using your selected method.

"Red Flag" means a Device's IMEI or serial number has a record of being blocked, lost, stolen, or subject to an ownership dispute.

"Quarantine Period" means the twenty-eight (28) day period during which we hold a Device flagged as lost, stolen, or disputed.

"UK Model" means a Device originally manufactured and sold for the United Kingdom market with original, unmodified software.

Accessing the Services

We reserve the right to withdraw or amend our Services at our sole discretion and without notice. We will not be liable if for any reason all or any part of the Services is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Services, or the entirety of the Services, to certain users.

To access or use the Services, you may be asked to provide certain registration details or other information, or may be provided with a username, password, or other similar credentials as part of our security procedures.

As a condition of your use of the Services, you agree:

  • that you will not utilise any automated means to use or access the Services in whole or in part;
  • that you are prohibited from using or accessing the Services if you are a person or entity barred from receiving the Services under the laws of the United Kingdom or other countries;
  • to maintain the confidentiality of any account, and any associated credentials, you use on or for the Services;
  • that any information that you provide on the Services will be correct, current, and complete;
  • that you are solely responsible for all access to and use of the Services by anyone using your account or other identification or credentials;
  • to notify us immediately of any unauthorised use of the Services; and
  • not to sell, transfer, or assign your account or credentials, or any rights therein.

One Account Per Person

You may only have one account per person. If you are found to have more than one account, we shall be entitled to immediately terminate all of your accounts, cancel any active orders, and we may charge you a reasonable administration fee based on the costs incurred by us in doing so. We reserve the right to reject transactions which contain multiple Devices of the same brand and model, and to reject repeat transactions that appear to be duplicates or that we suspect may be fraudulent.

Information Collected About You

All information that you provide to us, including, but not limited to, through the use of any interactive features on the Services, or that we otherwise collect on the Services, is governed by our Privacy Policy, and you consent to all actions we take with respect to your information consistent with our Privacy Policy.

Trade-In Terms and Requirements

In order to complete a Trade-In or any other transaction with ItsWorthMore, you agree to:

  • Provide accurate, true, and up-to-date account information about yourself and any Product you submit to us.
  • Comply with all terms and conditions as outlined in these Terms.
  • Comply with all applicable laws and regulations, including all import and export laws.
  • Transact on your own behalf and not on behalf of others.
  • Be at least eighteen years of age and have the legal competency and capacity to enter into legally binding agreements.
  • Be able to convey clear and unencumbered title and interest in any Product that you send to us.
  • Ensure that any Apple devices you submit do not have a corporate lock or IT policy.
  • Ensure that any Device you submit is a UK Model with original, unmodified software that has not been jailbroken, rooted, or otherwise tampered with.

ItsWorthMore cannot accept devices with corporate locks or IT policies. Before sending such a device, you must contact the associated company to have the restrictions removed.

ItsWorthMore does NOT purchase devices that are Activation locked, Find My locked, FRP locked, Google locked, Samsung locked, Firmware locked, or that have Apple Stolen Device Protection or Android Theft Protection enabled. These newer security features cannot be bypassed and render the device unpurchasable. You must remove any security features before we can process them.

If we receive a device that has a device lock that cannot be removed, we are unable to purchase it and you will be charged a return fee of £15.00, which covers the cost of handling and in/outbound shipping. If we do not hear back from you after fourteen (14) days from the date of the email notifying you of the device lock, we will assume the device has been abandoned and will recycle your device.

To receive payment for any Products in connection with a Trade-In, you must provide current information including a valid email address at which you can receive emails, a valid postal address at which you can receive post, and your first and last name. ItsWorthMore may, at its sole discretion, pay you by bank transfer.

All devices are checked on lost/stolen databases (including CheckMEND and similar services) to ensure they have not been reported as lost or stolen. ItsWorthMore does not, under any condition, purchase devices that are flagged as lost, stolen, blocked, or subject to an ownership dispute. Your personal information along with the device's Serial/IMEI will be turned over to legal authorities upon request.

All Offers shall be based on ItsWorthMore's own determination of the Product value in reliance on the accuracy of the information you supply. ItsWorthMore will use its sole discretion to determine the Product value, considering factors including the Product's model, functionality, condition, and whether Product accessories have been provided.

You must have all legal right, title, and interest in any Products you seek to sell to ItsWorthMore, and all Products must be able to be activated for new service unless the Product is incapable of being activated due to its condition.

Your Trade-In product must be received by ItsWorthMore within twenty-one (21) days. Any item received past the twenty-one day period is subject to a price adjustment to reflect the prices offered at the date the item is actually received.

UK Model Requirement

All Devices submitted must be UK Models with original software and hardware that has not been modified, jailbroken, or rooted. Non-UK variants (including devices originally sold in the US, EU, or other regions) may have different specifications, warranty status, or network compatibility and may be rejected or subject to a reduced Offer. If we determine that a Device is not a UK Model, we reserve the right to return it at your expense or offer a revised valuation.

Counterfeit and Non-Original Devices

ItsWorthMore does not purchase counterfeit, replica, or non-original devices. If we receive a device that we determine to be counterfeit or non-genuine, we will be unable to make any payment for it. You will be required to cover the return postage costs (£15.00), or if we do not hear from you within fifteen (15) days, the device will be responsibly recycled and disposed of. We reserve the right to report suspected counterfeit goods to the appropriate authorities.

Devices Under Finance or Network Contracts

Devices that are on an asset watch list (typically as a result of being within the first six months of a contract with a network provider such as EE, Vodafone, O2, or Three) are unable to be purchased during this period due to the network's vested interest in the device. If we receive such a device, we will return it to you subject to a return fee of £15.00 per order. You warrant that any Device you send to us is fully paid off, not subject to any outstanding finance agreement, and not subject to any network restrictions that would prevent its resale.

Product Condition and Pricing Accuracy

ItsWorthMore strives to make the process of submitting your electronics as simple as possible. Although pricing is subject to change, you will typically receive the amount you were initially quoted when you submitted your Product.

Products submitted to ItsWorthMore should be assigned to one of the following condition categories:

Brand New — An item that is still in factory original packaging. Must include the original box and all accessories sealed and untouched.

Flawless — An item that is new or in nearly perfect condition and is one hundred percent (100%) functional. May have up to 3 very light scratches on the screen and up to 5 light scratches on housing. No cracks, dents, scuffs, missing paint, pressure marks, screen burn, or dead pixels.

Good — An item showing light to moderate signs of use but still in good condition. Must be one hundred percent (100%) functional. May have more than 3 light scratches on the screen and more than 5 light scratches on housing. Some dents, scuffs, or chips may be present.

Fair — An item showing excessive signs of wear. Must be one hundred percent (100%) functional.

Broken — An item with significant physical damage, wear, or broken parts. Core functions (power on, touchscreen response, connectivity) must still work. Faults may include cracked screens, faulty buttons, liquid damage indicators triggered, or other functional issues.

The categories outlined above are broad general statements as to the condition of an item. On each Offer page, you will see more specifics about what is included in each category for that particular item. ItsWorthMore reserves the right to change the specifics of each category for a particular item at any time. If you have already sent your item prior to these changes, your Offer will not be affected.

Some issues with an item may not be obvious when you submit your electronics. Certain issues may only be identified by an ItsWorthMore Technical Specialist. Based on ItsWorthMore's analysis, the price of your electronic device may be adjusted if you have indicated the wrong model or if the condition is different from your representation.

As part of ItsWorthMore's evaluation, the following factors may also affect your Offer:

Battery Health — If the battery health of your device is found to be less than eighty percent (80%), ItsWorthMore will adjust the price to reflect reduced battery performance. Devices with battery health below 80% will typically be downgraded by at least one condition tier.

Engraving — Devices with personal engravings will generally be downgraded by one condition tier.

Non-UK Model — Devices that are not UK Models may be rejected or receive a significantly reduced Offer.

Missing Stylus — Where applicable (e.g., Samsung Galaxy Note series), the stylus must be included. Missing stylus will result in a downgrade.

In some cases, ItsWorthMore may also provide a higher payment than initially quoted based on this evaluation. If you are unsure how to categorise your electronic device, please contact us for assistance.

ItsWorthMore has sole discretion to make the final evaluation of all electronic devices sent to us. If there is a change in the pricing of your Product, ItsWorthMore will notify you, and you will have fourteen (14) days (the "Grace Period") to accept or decline the Revised Offer. During the Grace Period, we will send you regular reminder emails. If 24 hours before the end of the Grace Period we have not received your response, we will make efforts to send you a final reminder. If you do not respond within this period, ItsWorthMore will assume you have accepted the Revised Offer and proceed with payment using your selected method.

Offers are valid for twenty-one (21) days. If your item is received after this period, ItsWorthMore will re-evaluate and price it based on current market value.

ItsWorthMore determines, in its sole discretion, which Products are eligible for Trade-In through the Services or websites and which Products will receive an Offer. ItsWorthMore may terminate the eligibility of certain Products at any time without advance notice. This termination will not affect any Products for which you have already accepted a valid Offer.

For items in the "Broken" category, ItsWorthMore has attempted to include the majority of extreme damages. However, certain damages may fall outside the scope of this category, and the price will be adjusted accordingly. If ItsWorthMore's Technical Specialists determine that a device has been opened or tampered with, the originally quoted Offer will be adjusted in accordance with these Terms.

Trade-In Process

Once you have shipped your electronic device(s), please allow up to five (5) business days for them to arrive at ItsWorthMore.

When packaging your Product to send to ItsWorthMore, you must include all materials included in your description on which we based the Offer which may include software, accessories, adapters, and manuals. Your failure to include any items you represented to us when the Offer was calculated or sending us a Product which does not match your original description, may modify the final value of your Product and may result in a Revised Offer.

IMPORTANT: Please DO NOT send accessories, original boxes, or packaging materials unless specifically requested, as we will not be able to return them if you decline a Revised Offer. Any accessories received will be disposed of responsibly.

Once ItsWorthMore has received your electronic device(s), it typically takes up to three (3) business days for ItsWorthMore's Technical Specialists to analyse the status of your device.

After ItsWorthMore has assessed the status of your device, payment will be sent using bank transfer or a Revised Offer will be provided if ItsWorthMore determines that your device is not in accordance with the condition you originally selected. You will have up to fourteen (14) days to accept or decline this Revised Offer. If you do not respond within fourteen (14) days, ItsWorthMore will assume you have accepted the Revised Offer and proceed with payment.

If ItsWorthMore provides you a Revised Offer because ItsWorthMore's Technical Specialists determine your own assessment of your device is inaccurate and you decline the Revised Offer within the Grace Period, ItsWorthMore will return your electronic device to you free of charge.

If you do not respond to ItsWorthMore's email regarding the Revised Offer within fourteen (14) days, ItsWorthMore will continue with processing. If your item has no value according to ItsWorthMore's assessment and you do not respond within fourteen (14) days, ItsWorthMore will recycle your device and you will receive no payment or return of the item.

In order to test your device(s), ItsWorthMore's Technical Specialists may remove the casing and protective layers of your device. If you request your device(s) back during this process, ItsWorthMore shall not be responsible for these items.

Please note that free return shipping does not apply in the following scenarios:

  • Item was significantly misrepresented;
  • Item was found to be reported lost or stolen;
  • Item was found to have an Activation, iCloud, Find My, or similar security lock;
  • Item was found to have Apple Stolen Device Protection or Android Theft Protection enabled;
  • Item was found to have a bad ESN or financed IMEI;
  • Item was found to be a counterfeit or non-original device;
  • Item was found to be on an asset watch list or subject to network finance.

Please allow up to three (3) days for processing after you accept an Offer. You may track the status of your device(s) at any time through your ItsWorthMore account.

For orders valued at one thousand pounds (£1,000.00) or more, please allow an additional three (3) business days for processing.

Risk of Loss and Shipping Protection

ItsWorthMore provides a prepaid shipping label for your convenience. The risk of loss associated with shipping your device to us is defined as follows:

Standard Liability (Free)

Unless Shipping Protection is purchased, the risk of loss or damage remains with the sender (you) until the package is successfully received and confirmed by ItsWorthMore staff at our processing facility. Our standard liability for transit loss or damage is limited to the carrier's free standard coverage, and is contingent upon carrier approval of the claim.

Standard carrier coverage limits are approximately:

  • Royal Mail Tracked 48: up to £150
  • Royal Mail Special Delivery: up to £750 (requires you to file the claim)
  • DPD / Evri: up to £100

We recommend that if you have an order of significant value, you use Royal Mail Special Delivery or purchase Shipping Protection.

Shipping Protection Upgrade

If you purchase Shipping Protection at checkout, ItsWorthMore agrees to waive the standard liability limits stated above. We will assume the risk of loss and pay the full Offer Value of the device in the event of documented transit loss or damage, contingent upon all requirements necessary for ItsWorthMore to file a valid carrier claim being met.

Payout Conditions and Exclusions

Shipping Protection is a contractual service guarantee against loss or damage in transit and is subject to the following strict conditions:

(a) Assumption of Risk: Our liability for the package begins immediately upon the initial carrier scan ("Accepted" or "Picked Up"). Packages dropped off without an acceptance scan, or packages lost or stolen before carrier possession, are not covered.

(b) Contents Verification: The protection covers the shipping event (loss/damage). If the package arrives at our facility empty, or if the contents do not match the original Offer details upon inspection, the protection is void, and no payment will be issued.

(c) Inadequate Packaging: We are not liable for damage caused by the sender's failure to use appropriate cushioning or a rigid box.

(d) Subrogation: By accepting a payout for a covered loss or damage claim, you assign all rights and claims against the carrier to ItsWorthMore.

(e) Claim Status: The protection is void if the customer requests the return of the item, or a refund of the Shipping Protection fee, before or during the claim resolution process. You must fully cooperate with any investigation required by the carrier or ItsWorthMore.

(f) Proof Requirements: You must retain your posting receipt and provide it upon request. You must notify us in writing of any loss or damage within twenty-eight (28) days of the date on which your package was accepted by the carrier. Failure to provide a valid receipt or notify us within this period may invalidate your claim.

ItsWorthMore reserves the right to deny a claim due to inconsistencies with the information provided or any claims that the company deems fraudulent, regardless of the courier decision.

(g) Return Shipments: If you decline our updated offer or otherwise request the return of your device, any return shipment from ItsWorthMore to you is not insured or covered for loss or damage under our Standard Liability (Free). Return shipping is covered only if you purchased Shipping Protection and the return shipment is sent using our label and process. If Shipping Protection was not purchased, the risk of loss or damage during return transit remains with you, and any recovery is limited to the carrier's standard coverage (if any) and subject to carrier claim approval. For any covered return shipment, the declared/covered value is the device value as determined by ItsWorthMore during inspection (the "Post-Inspection Value").

Ownership, Title and Lost/Stolen Checks

ItsWorthMore runs lost/stolen/blocked checks on all Devices using industry databases including CheckMEND and similar services.

If a Device is reported stolen, blocked, financed, or otherwise restricted (a "Red Flag"):

  • We will notify you by email and quarantine the Device for an initial period of twenty-eight (28) days (the "Quarantine Period").
  • During the Quarantine Period, you will be required to prove that you are the rightful owner and have the lost/stolen records cleared.
  • If the Device is cleared during the Quarantine Period, your sale will be processed as normal.
  • If the Device is not cleared within the Quarantine Period, we will be required by law to retain the Device, pass it to the Police or other law enforcement body, or dispose of it. No payment will be issued.
  • We may notify law enforcement or the rightful owner.

By entering into this contract, you expressly agree to these actions and acknowledge that UK legislation prevents us from returning or paying for any Device which is lost, stolen, or recorded as such.

If you have received payment from us for a Device which we subsequently become aware of an ownership issue, you agree to immediately reimburse us in full within three (3) business days following a written request, pending investigation.

Title transfers to ItsWorthMore Limited upon:

  1. Your acceptance (or auto-acceptance after the Grace Period expires) of the applicable Offer, AND
  2. Issuance of payment.

If the Product is returned to you, title shall not pass to ItsWorthMore and shall remain with you.

Payment

Payment is issued within one (1) business day after acceptance of an Offer, subject to the Quality Assessment having been completed before 2pm on that business day. Payments processed after 2pm or on weekends/bank holidays will be made on the next business day.

Payment is made by bank transfer and typically clears within 24 hours.

Incorrect payment information may delay payment. You expressly understand and agree that if you fail to provide us with accurate and up-to-date information about yourself, ItsWorthMore shall not be responsible for any Trade-In payments sent to a wrong account. We cannot, under any circumstances, recall or reissue bank transfer payments once they have been made.

All payments are inclusive of VAT so that you can see the total payment you will receive (subject to these Terms).

Set-Off Rights

We shall be entitled to set-off any sums properly due and owing to us under any contract made between you and us (including return fees, administration fees, or amounts owed due to ownership disputes) against any sums owed by us to you under the same or any other contract between us. We will inform you in writing of any set-off carried out by us pursuant to this provision.

Return of Devices

If you decline a Revised Offer within the Grace Period, we will return your Device to you at no additional cost. The Device will be dispatched on the next business day via a tracked courier service with coverage up to £150.

If you require enhanced return coverage (up to £750), please contact our customer service team to arrange this for an additional fee.

It is your sole responsibility to ensure that the address details provided in your account are valid, accurate, and correct. We shall not be liable for any loss of any kind that you may incur due to Devices being returned to an invalid or incorrect address.

We will alert you via email when your Device is due to be delivered. If your Device is not delivered when expected, you must notify us within fourteen (14) days of the agreed delivery date. Failure to notify us within this period may invalidate any claim for non-delivery.

Upon notification of non-delivery, you may be required to complete a 'Letter of Denial of Receipt' within seven (7) days. We shall be entitled to make such investigations as we deem necessary to satisfy ourselves of the validity of any claim.

In calculating the value of any return claim, we shall accept no other valuations than our original Offer value, and under no circumstances do we accept any liability for any other loss, damage, or compensation resulting from the return of your Device.

Business Sellers (Additional Terms)

Business Sellers warrant that:

  • They legally own the Devices
  • Devices are free of finance and not on any asset watch list
  • Devices have not been tampered with or modified
  • Devices are UK Models with original software
  • They have authority to sell them

Business Sellers agree to indemnify ItsWorthMore Limited against claims arising from breach of these warranties.

Our total liability to Business Sellers is limited to the agreed Device value.

B2B Sales by ItsWorthMore Limited

ItsWorthMore Limited does not currently sell products directly to UK consumers via its website. Any consumer retail sales occur through third-party e-commerce platforms. Any direct UK sales by ItsWorthMore Limited are business-to-business only.

  • ItsWorthMore sells Devices only to business buyers or through third-party platforms.
  • Title passes upon receipt of full payment.
  • Risk transfers upon delivery.
  • Returns are accepted only for material misdescription.
  • Devices are sold according to ItsWorthMore's grading criteria.

VAT and Margin Scheme

ItsWorthMore Limited operates under the VAT Margin Scheme for second-hand goods.

Under this scheme:

  • VAT is included in the price
  • VAT cannot be reclaimed by buyers
  • Invoices state: "VAT Margin Scheme — second-hand goods. No reclaimable VAT."

Linked Sites

The Services may provide links to other third-party websites ("Linked Sites"). ItsWorthMore has not reviewed all of the information on the Linked Sites, does not maintain Linked Sites, and cannot control the completeness, accuracy, or security of the content contained on any Linked Site, or the privacy policies of any Linked Site.

The content, materials, and information contained on any Linked Site is solely the responsibility of the provider of that Linked Site. ItsWorthMore is not responsible for the contents of any such Linked Site, and the inclusion of any link to a Linked Site does not imply endorsement by ItsWorthMore of the Linked Site.

If you decide to access any Linked Site, you do this entirely at your own risk.

Intellectual Property Rights and Ownership of the Services

The Services and its entire contents, features, and functionality, including without limitation all information, copyrights, patents, trademarks, service marks, and trade names, as well as all logos, text, design, graphics, displays, video, logos, icons, images, audio, downloads, interfaces, code, and software, as well as the selection and arrangement thereof, and all other intellectual property (collectively, the "Content"), are all proprietary and owned or controlled by ItsWorthMore, its licensors, or other providers of such material and are protected by United Kingdom and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms grant you a limited, revocable, nontransferable, nonexclusive licence to use the Services and Content solely for your own personal, non-commercial use. You understand and agree that this licence is not a transfer of title, right, or interest in the Services or Content.

This licence shall automatically terminate if you violate any of these restrictions, or any provision of the Terms, and may be terminated by ItsWorthMore at any time for any or no reason.

Accuracy of Information and Reliance on Information Posted

ItsWorthMore attempts to ensure that information on the Services is complete, accurate, and current. However, despite our efforts, the information on the Services may occasionally be inaccurate, incomplete, or out of date.

Accordingly, we do not warrant the completeness, accuracy, timeliness, or usefulness of any information on the Services, and any reliance you place on such information is strictly at your own risk.

You also agree that the inclusion of any products or services on the Services at a particular time does not imply or warrant that these products or services will be available at any time. Pricing or availability errors may occur on the Services. ItsWorthMore reserves the right to cancel any orders or transactions containing pricing or availability errors, with no further obligations to you.

Prohibited Uses

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services:

  • In any way that violates any applicable law or regulation.
  • For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
  • To transmit any advertising or promotional material without our prior written consent.
  • To impersonate or attempt to impersonate ItsWorthMore, an ItsWorthMore employee, another user, or any other person or entity.
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services.
  • To sell, recycle, or trade devices that you do not legally own.
  • To create multiple accounts or submit duplicate orders.

Additionally, you agree not to:

  • Use any robot, spider, or other automatic device to access the Services.
  • Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
  • Attempt to gain unauthorised access to any parts of the Services.
  • Attack the Services via a denial-of-service attack or a distributed denial-of-service attack.

Consumer Cancellation Rights

This reflects that the contract has been fully performed once payment is issued, at which point the statutory cancellation right no longer applies under the Consumer Contracts Regulations 2013.

Under the Consumer Contracts Regulations 2013, if you are a Consumer, you have the right to cancel your trade-in within fourteen (14) days of submitting your request online (the "Cooling-Off Period").

Note: Once you have accepted (or auto-accepted after the Grace Period expires) an Offer and payment has been issued, the transaction is complete and the cancellation right no longer applies.

Data Protection and Privacy

ItsWorthMore Limited is committed to protecting your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

What we collect: Your name, contact details, bank account information, Device identifiers (IMEI/serial numbers), and transaction history.

How we use it: To process your trade-in, issue payment, verify Device ownership, comply with legal obligations, and prevent fraud.

Legal basis: Contract performance, legal obligations (e.g., anti-money laundering), and legitimate interests (fraud prevention).

Data sharing: We may share data with courier services, payment processors, law enforcement (where required), lost/stolen device databases (such as CheckMEND), and network operators.

Retention: We retain transaction records for 7 years for tax and legal compliance purposes.

Your rights: You have the right to access, correct, delete, or port your data, and to object to or restrict processing. Contact us at [email protected] to exercise these rights.

We may disclose your details to the Police or other authorised bodies (such as network operators and insurance companies) for the purpose of investigating or preventing crime. By entering into this contract you agree to us supplying data for the prevention and detection of crime, arrest and prosecution of offenders, or for the recovery of stolen property.

Data Removal from Devices

We recommend that you delete all personal information ("Data") that is or may be stored on your Device (including images, passwords, contacts, messages, songs, etc.) before sending it to us.

Please ensure that you remove any SIM cards, media storage cards, memory cards, or similar devices from your Devices prior to sending them to us. If we discover that your Device includes any such items, we shall have no responsibility to return these and shall dispose of them responsibly.

We shall have no liability for any losses, claims, or damages arising in respect of any Data which you fail to delete from your Device (whether knowingly or unknowingly).

It is your responsibility to cancel any airtime contracts, subscriptions, or similar services linked to each Device. We are not responsible for any charges arising before or after receipt of your Device.

By sending ItsWorthMore the Device, you expressly agree to release ItsWorthMore from any claim as to the Device, the Data stored in such Device, or for such Data's security, integrity, confidentiality, disclosure, or use.

Disclaimers and Limitation of Liability

To the extent that we are liable to you for breach of contract, negligence, or any other liability arising under these Terms, our liability shall at all times be capped at the Valuation of the Device(s) which is the subject of your claim.

We do not exclude or limit liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any breach of the obligations implied by section 12 of the Sale of Goods Act 1979 or the Consumer Rights Act 2015
  • Any other liability that cannot be excluded or limited under English law

Subject to the above, we are not liable for:

  • Loss of data
  • Loss of profits, sales, business, or revenue
  • Business interruption
  • Loss of anticipated savings
  • Any indirect or consequential loss or damage
  • Losses caused by incorrect bank details you have provided
  • Any loss arising from your failure to remove Data from your Device

Our total liability to Business Sellers and Business Buyers is limited to the transaction amount.

Nothing in these Terms shall affect your legal rights as a Consumer.

Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless ItsWorthMore and its officers, directors, employees, and agents from and against any claims, losses, liabilities, damages, costs, or expenses, including legal fees, that may arise from or in connection with:

  • Your use of the Services
  • Violation of these Terms by you
  • Your violation of any law or the rights of a third party
  • Any breach of your representations and warranties
  • Any ownership dispute relating to a Device you have sent to us
  • Any claim that you did not have the right to sell a Device

It is your responsibility to discontinue phone, internet, or any similar service on your Product prior to selling it to ItsWorthMore. ItsWorthMore shall not be responsible for any service charges related to your Product.

Force Majeure

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemic, strikes, or shortages of transportation, facilities, fuel, energy, labour, or materials.

Our performance will be suspended while the uncontrollable event continues, and we will have an extension of time to perform our obligations. If the uncontrollable event continues for more than one month, we or you may end the contract by giving seven (7) days' notice in writing.

Complaints

If we cannot resolve your complaint, you may be entitled to use alternative dispute resolution (ADR) services approved in the United Kingdom. Details are available from Trading Standards or Citizens Advice.

Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales.

The courts of England and Wales have exclusive jurisdiction over any dispute arising from or related to these Terms.

If you are a Consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a Consumer to rely on such mandatory provisions of local law.

Additional Terms

The failure of ItsWorthMore to enforce any term or condition set out in these Terms shall not be deemed waiver of such term or condition or a waiver of any other term or condition. A waiver of a right under these Terms will not be effective unless it is stated to be a waiver and is communicated in writing.

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms will continue in full force and effect.

These Terms and our Privacy Policy constitute the sole and entire agreement between you and ItsWorthMore regarding the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services.

A person who is not a party to these Terms shall have no rights in relation to these Terms under the Contracts (Rights of Third Parties) Act 1999.

Any provisions that, by their nature, are intended to survive shall survive any termination of these Terms.

Changes to These Terms

We may update these Terms periodically to reflect changes in market conditions, technology, payment methods, relevant laws, and our systems. Changes apply only to future transactions. You will be subject to the Terms in force at the time that you place an order with us.

We will notify you of any material changes by posting the new Terms on this page with a new "Last Updated" date. We recommend that you check this page regularly for changes.
